Notification for AEs and Contractors Regarding Bid Doc Revisions

CDB has revised Divisions 0 and 1 that are included in a project’s Project Manual (specifications). The changes to the bid documents are rather minimal but impact the bidding process in a big way, especially for Single Prime projects. In response to a recent trend of Single Prime bid rejections due to the submission of incomplete bid forms by bidders, CDB has revised language to make it more clear what the bidders have to provide regarding protected subcontractors and the consequences for not providing the required information. You will see revisions in the Single Prime bid documents, both Division 0 and Division 1, that address this issue.
For Architect/Engineers, you will also see that a threshold has been adopted to address small scopes of work for certain trades: any trade estimated to be under $50,000 in value will not have to be listed on the bid form as a protected subcontractor. This means that only trades valued at $50,000 should be shown on the bid form as protected subcontract work (including the trade that will be the prime bidder), and that subcontractors do not have to be prequalified for trade work that is not listed as a protected subcontractor.
For bidders, an important note: for any trade that is listed on the bid form as a protected subcontractor, the bidder must provide information for each trade or it will result in immediate rejection of the bid (material deficiency). Leaving a line blank or putting Not/Applicable (N/A) is not acceptable. This has been the primary reason for recent bid rejections and the use of the $50,000 threshold should be very helpful in eliminating those types of rejections. Only one subcontractor can be listed for each trade. If a bidder feels that a bid form has a trade inappropriately listed as a protected trade, then the bidder should contact the A/E for a potential addendum to address the issue.
The $50,000 threshold will also be applicable to multiprime projects. Any trade estimated by the A/E to be under $50,000 (instead of the current $44,100 threshold) will not have to be bid as a separate trade.
Another revision to the bid documents is the minor tweaking of language in the Supplement to the SDC regarding MBE/FBE/VBE goal compliance and good faith efforts. The intent of the language has not change, but revisions do include clarifications of definitions and corrections of typos or missing words.
Finally, a very minor revision is the removal of the contract number on the Illinois Office Affidavit Form (00 41 02).
The revised bid documents will be placed on Reference Library on Thursday, April 28, 2016 and should be used immediately by A/E’s in the preparation of the Project Manual. The sections affected within Division 0 and Division 1 will be designated in the page footer with an effective date of May 1, 2016.
The following sections are affected by the revisions:
Single Prime Division 0:
00 11 13 Advertisement for Bids: language is revised to emphasize the requirement to provide a protected subcontractor as listed on the bid form 00 41 00.
00 41 00 Bid Form: language is revised to emphasize the requirement that each trade line needs to be completed for either the prime bidder or a protected subcontractor. Only trades over $50,000 should be provided on the form when the A/E develops the bid documents. For example, if the A/E estimate for a trade is $55,000, then that trade should be shown as a protected subcontractor. The bidder will have to show a protected subcontractor, even if the protected subcontractor cost is estimated by the bidder to be less than $50,000. Any line left blank or marked N/A will result in bid rejection.

Single Prime Division 1:
01 11 00 Project Summary: reference to the option for multiprime contracts has been deleted.
01 11 01 Supplement to the SDC: several changes are made to language regarding MBE/FBE/VBE in order to clarify or better define BEP requirements such as good faith effort and commercially useful function.
